Right of access

The right of access according to Art. 25 DPA allows any person to obtain information about their data stored with Gemeinsame Einrichtung KVG. This right is exercised through a written request, accompanied by an identity document for the identification of the requesting person. If the request is made by a legal representative, a valid power of attorney is also required.
The information is provided in writing or in the form of the available data and includes details about the stored data, their origin, purpose, and retention period. Gemeinsame Einrichtung KVG processes such requests within 30 days. The information is generally provided free of charge unless the effort involved is disproportionate. Access may be restricted or denied in certain cases, such as to protect the overriding interests of third parties, particularly professional secrecy or legal provisions. Similarly, the request may be denied if it is manifestly unfounded, pursues a purpose contrary to data protection, or is clearly abusive. In special cases, Gemeinsame Einrichtung KVG may require that the data be transmitted to a physician.
